Zimmer NexGen Knee Bellwether Trial Scheduled to Take Place in October, Says Lawsuitsettlementnews.com
Lawsuit Help Center website reports that the judge overseeing the Zimmer NexGen knee implant lawsuits issued a scheduling order for the first bellwether trial to begin October 13th, 2015.
PHILADELPHIA, June 25, 2015 /PRNewswire/ -- MT Services LLC, a Lawsuit Settlement News Reporting Company which operates lawsuitsettlementnews.com, announced today that in the multidistrict litigation (MDL) over the Zimmer NexGen Knee implant lawsuits, the judge overseeing the MDL has issued that the first bellwether trial will begin October 13th of 2015. Currently, there are over a thousand cases which have been consolidated before a federal judge in Illinois. Zimmer Inc. had issued voluntary recalls for its metal-on-metal hip device – the Durom Cup, in 2008 – and another recall for the NexGen MIS Tibial Components in 2010. Those recalls led to lawsuits which are pending in a federal multidistrict litigation (In Re: Zimmer Durom Hip Cup Products Liability Litigation, MDL No. 2158) and the MDL in question in Illinois (In Re: Zimmer NexGen Knee Implant Products Liability Litigation, MDL No. 2272).
Additionally, prior to the announcement of the upcoming bellwether trial, the FDA announced a Class II recall for Zimmer's Persona Trabecular Metal Tibial Plate knee implant. The recall affects all lots and sizes of the knee implant, affecting all 11,658 devices that were recalled, according to the FDA's website. Also, according to an announcement made by the FDA, they said Zimmer Inc. initiated a voluntary recall of their Persona Trabecular Metal Tibial after there was an increase in complaints of loosening and radiolucent lines. All sizes and lots of the affected devices will be removed from the market and will no longer be distributed.
Chris Janish, CEO of MTS, commented on the recent announcement, "Just as the NexGen litigation is starting to pick up steam, it is concerning that the Zimmer Persona knee seems to just be the start of yet another knee recall litigation. Plaintiffs who have had complications from either of these Zimmer products should take immediate notice and contact us immediately."
