Wisconsin WR Quintez Cephus Sues University over Title IX Due Process
NEW YORK, Oct. 10, 2018 /PRNewswire/ -- Represented by the law firm of Nesenoff and Miltenberg, LLP, University of Wisconsin (UW) football player Quintez Cephus is suing the university because he says a Title IX process the school is pursuing violates his rights as he defends himself in a criminal case.
Cephus is alleging two counts of 14th Amendment violations (Due Process and Equal Protection) and one Count 42 U.S.C. 1981 Racial Discrimination by UW. The crux of the lawsuit is that the University is violating Cephus' rights by proceeding with the Title IX Investigation knowing that he is facing criminal charges.
Further, UW officials know that there is evidence that the District Attorney's office has and won't give to the University until after the criminal proceeding is over. The school is forcing Cephus to in effect choose between participating in the Title IX proceeding and giving up his 5th amendment right to remain silent. All of his statements given to the University would be provided to the DA's office.
"Due process – two words that are among the principles that we hold most dear in our democracy. It is one of those concepts that we usually do not notice until it gone. And Quintez has had his rights stripped from him by this public school," said Andrew Miltenberg, Cephus' attorney and Title IX expert. "UW should want a process of fairness, equity and transparency but the schools' administrator, Lauren Hasselbacher, has a history of ambushing students and stripping them of their rights."
