Wiggin and Dana Achieves Victory In Federal Jury Case
RBC Aircraft Products, Inc. vs. Precise Machining and Manufacturing, L.L.C.
NEW HAVEN, Conn., Feb. 28, 2013 /PRNewswire/ -- Wiggin and Dana trial lawyers Joseph W. Martini and Matthew C. Brown successfully concluded a two week jury trial in the United States District Court for the District of Connecticut, obtaining a multi-million dollar jury verdict for the firm's client RBC Aircraft Products, Inc. (RBC). RBC is an international manufacturer of highly engineered precision bearings for the diversified industrial, aerospace, and defense markets. At issue in this jury trial, were competing views of the parties' agreement formed through their exchange of commercial forms, namely, a quote, purchase order and acknowledgment. A quintessential "Battle of the Forms" case, the jury found that the parties entered into a five-year requirements contract and that RBC was entitled to lost profits as damages under the Uniform Commercial Code. The trial included eight fact witnesses, two experts on industry custom and trade usage, a damages expert, and was tried before the Honorable Stefan R. Underhill.
