The book provides a detailed but concise introduction to the Consumer Financial Protection Bureau, a snapshot of the Dodd-Frank Wall Street Reform and Consumer Protection Act's changes to mortgage-lending regulation—including the changes to TILA, RESPA, and other consumer financial laws–and a detailed, section-by-section commentary on the Titles of Dodd-Frank that deal with these topics. The commentary for each section is preceded by the statutory text, and comprises a general commentary, followed by a detailed explanation of selected terms and provisions. Together, the introduction and commentary provide a clear picture of what this landmark law does and does not do, and a roadmap for where the authors believe it will lead in the near future, as hundreds of required regulations and studies are commenced. It should be a great resource, in particular, for reviewing, studying and analyzing the implications of the statutory language, which both authorizes and limits the coming wave of regulations and administrative interpretations.
"The passage of Dodd-Frank and the creation of the Consumer Financial Protection Bureau have completely changed the regulatory environment for bankers, mortgage bankers, and financial services companies," said WBSK managing partner Mitchel H. Kider. "We wrote this book because companies in the financial services industry, and the lawyers who represent them, needed a guide to walk them through the new regulatory landscape and to explain, in plain language, the changes that have already taken effect, as well as the changes that are on their way."
This is the second book by WBSK attorneys on the subjects of mortgage banking and financial regulatory reform that West has published in the past year. Previously, West published Real Estate and Mortgage Banking: A New Era of Regulatory Reform, authored by Mr. Kider and WBSK partner David M. Souders.
