Washington, DC Injury Attorneys Reach Settlement for Victim Injured by DC Police Officer's Use of Excessive Force
Washington, DC Personal Injury Attorneys Allan M. Siegel and Matthew Tievsky were successful in securing a $350,000 settlement on behalf of a woman who was seriously injured by a District of Columbia Police Officer.
WASHINGTON, Oct. 27, 2014 /PRNewswire/ -- Every case is different. Settlements and verdicts in all cases depend on various factors and circumstances which are unique to each individual case. Past case results are not a guarantee or prediction of similar results in future cases in which Chaikin, Sherman, Cammarata & Siegel, P.C. or its lawyers may undertake.
Chaikin, Sherman, Cammarata & Siegel, P.C. has established itself as a proven personal injury law firm that fights for victims who suffer injuries as the result of another's negligent or wrongful acts, no matter who the at-fault party may be. As proof of their commitment to their clients and their fight for justice, Partner Allan M. Siegel and Associate Matthew Tievsky have successfully settled a lawsuit filed against the District of Columbia and one of its police officers. Attorneys Siegel and Tievsky alleged that the police officer's use of force was unreasonable, and caused serious and permanent injury to their client.
According to court records (Superior Court of the District of Columbia, 2011 CA 008475B), the case involved an incident that occurred at a DC nightclub in which the firm's client was pushed down a flight of stairs by a DC police officer. The firm's client was a patron at "The Scene" nightclub in D.C. when her friend got into a verbal altercation and was approached by the club's bouncers. The client and her friend were later escorted out of the club. When the client exited the club, the District of Columbia police officer walked up the steps and approached her.
Court records state the officer claimed that the firm's client stepped towards her with her fist balled, and that he felt his safety was threatened. The woman denied this claim. She claimed the officer then threw the woman down six steps, head first, where she landed on asphalt pavement, and suffered severe fractures to her left leg requiring three surgeries. She now has metal hardware in her leg and has a permanent injury that limits her ability to stand or walk for long periods of time, or do any high impact exercise or athletic activities. With the assistance of Siegel and Tievsky, the woman filed a claim alleging that the DC police officer violated her Constitutional right to be free from unreasonable force by law enforcement officers. The case was settled for $350,000 before trial was set to begin.
As personal injury attorneys, Partner Siegel and Attorney Tievsky fight to ensure that victims are able to hold at-fault parties accountable. In this particular case, Siegel and Tievsky succeeded not only in securing the compensation their client deserved, but also in exposing injustice within a public agency. "This case was not only a victory for our client," Partner Siegel said, "but also a victory for ensuring that law enforcement officers uphold their duties according to the law."
