USPTO Confirms Patentability of Over 350 Amino Acid/Nitrate claims in 10 of ThermoLife International's Patents
LOS ANGELES, Dec. 1, 2016 /PRNewswire/ -- ThermoLife International, LLC announced today that the United States Patent and Trademark Office (USPTO) has issued Notices of Intent to Issue Ex Parte Reexamination Certificates for ten (10) of ThermoLife's patents, which include over 350 claims (including 182 new claims) pertaining to amino acid/nitrates and their compounds, compositions, and uses. ThermoLife's nitrate-related inventions are based on groundbreaking recognitions regarding the benefits of supplementing the diet with nitrates, particularly to increase athletic performance, and have contributed to the popularity of nitrates in the sports nutrition industry. ThermoLife has licensed its patented technology to some of the largest sports nutrition companies in the United States. The favorable outcome in these reexamination proceedings has resulted in even stronger claims and has fortified ThermoLife's position and leading role in the industry.
The Patent Office's recognition of the patentability of ThermoLife's patent claims will allow ThermoLife to continue its patent enforcement actions, including those that have been stayed as a result of reexaminations. ThermoLife will now be vigorously enforcing its intellectual property rights through litigation against any company that sells infringing products without a license.
