U.S. Wire Rod Industry Obtains Favorable Determination from ITC That Extends Antidumping Orders for Five Countries, says Kelley Drye
WASHINGTON, May 30, 2014 /PRNewswire-USNewswire/ -- The U.S. International Trade Commission determined today that revoking the antidumping orders on imports of carbon and certain alloy steel wire rod ("wire rod") from Brazil, Indonesia, Mexico, Moldova and Trinidad & Tobago and the countervailing duty order on imports of wire rod from Brazil would likely lead to the continuation or recurrence of injury to the domestic industry. The Commission also determined that revoking the antidumping duty order on wire rod from Ukraine would not lead to continued or recurrent injury to the domestic industry. U.S. producers of wire rod applaud today's decision by the U.S. International Trade Commission to continue duties that offset unfair trading practices by the five countries.
As a result of the Commission's determination, the orders on wire rod from Brazil, Indonesia, Mexico, Moldova and Trinidad & Tobago will be continued for an additional five years. The existing order on imports of that product from Ukraine will be revoked.
"While we are surprised that the ITC did not continue the orders on imports from Ukraine, we are pleased with the Commission's determination regarding Brazil, Indonesia, Mexico, Moldova and Trinidad & Tobago. Maintaining these antidumping duty and countervailing duty orders will allow domestic producers to continue to compete in the U.S. market without the pernicious effects of dumping by the producers in those countries."
The existing orders have been in effect since October, 2002, following the domestic industry's successful prosecution of its case against unfairly traded imports. As a result of today's vote, the orders will remain in place until at least 2019, when a third sunset review proceeding will be undertaken.
The U.S. wire rod producers ArcelorMittal USA, Gerdau Ameristeel US, Keystone Consolidated Industries and EVRAZ North America are joined by the United Steelworkers in their support of continuation of the antidumping orders. They are represented in this proceeding by Paul Rosenthal, Kathleen Cannon and Alan Luberda of Kelley Drye & Warren LLP.
