Two More College Softball Teammates Sue Over Deadly Oklahoma Crash

DALLAS, Oct. 24, 2014 /PRNewswire/ -- The Law Offices of Frank L. Branson in Dallas has filed negligence lawsuits on behalf of two members of the North Central Texas College (NCTC) softball team who were seriously injured when a distracted commercial truck driver collided with a team van last month in Oklahoma. Four students were killed, and several injured.
NCTC student athletes Samantha Maddin and Kenedi Jackson sued Quickway Transportation Inc. and Wildhorse Fleet Services LLC of Nashville, Tennessee, and truck driver Russell Wayne Staley of Saginaw, Texas. The suits allege gross negligence led to the Sept. 26 crash on Interstate 35 south of Oklahoma City.
Mr. Staley told investigators that he was distracted and lost control of the 18-wheeler while reaching for something inside the truck cab. The Quickway tractor-trailer crossed the center median before striking the van carrying the students. Investigators found no indication that Mr. Staley applied the brakes before plowing into the van.
Ms. Maddin and Ms. Jackson filed their claims as part of a related Texas lawsuit in Tarrant County District Court, Estate of Brooke Deckard, et al. v. Quickway Transportation, Inc., et al., No. 352-274887-14. The new claims include a request that Mr. Staley, his supervisor and officials from Quickway and Wildhorse be ordered to answer questions and provide information related to the fatal crash within 50 days.
