PHILADELPHIA, Feb. 6, 2018 /PRNewswire/ -- Trial attorneys Thomas R. Kline, and Robert J. Mongeluzzi, following today's decision by a Court of Common Pleas Judge to hold Amtrak Train 188 Engineer Brandon Bostian for trial, stated, "By reversing the lower court, Common Pleas Court Judge Kathryn Streeter Lewis ordered a Philadelphia jury to decide Mr. Bostian's guilt or innocence as a result of what we have consistently believed was his reckless conduct. Our clients, who lost loved ones in the catastrophic derailment, were immediately relieved to hear the news of the decision and look forward to the jury trial, and the prosecution by the Pennsylvania State Attorney General's Office." They added, "It is significant that Mr. Bostian now faces the felony charge of risking a catastrophe."
Attorneys Kline and Mongeluzzi also noted that the state Attorney General's office charged Bostian with additional misdemeanor crimes that the Philadelphia District Attorney had previously declined to prosecute.
"We have long maintained that the charges faced by this locomotive engineer, who was responsible for the lives of 253 passengers and crew, are serious, warranted, and deserve to be heard by a jury in the city where the tragedy, in which eight people were killed, occurred," said the attorneys. They added, "This is an important step on the road to justice."
