Transvaginal Mesh Lawsuit Settlement News: Legal-Bay Lawsuit Settlement Funding Reports $18.5 Million Award for Plaintiffs in Latest Boston Scientific Mesh Trial
Case Funding Firm says the $18.5 million award in the latest trial comes just after Boston Scientific is ordered to pay $26.7 million over their defective vaginal implants.
MIAMI, Dec. 10, 2014 /PRNewswire/ -- Legal-Bay LLC, the Lawsuit Settlement Funding Company, reported today that a West Virginia jury has awarded $18.5M to plaintiffs in the latest Boston Scientific vaginal mesh trial. The four women plaintiffs involved were all implanted with the Obtryx mesh, a mid-urethral sling which is used to treat incontinence, and they alleged that the implanted device left them with nerve damage, infections, and pain during sexual intercourse. This case against Boston Scientific Corporation was the second federal case filed in multidistrict litigation over their pelvic mesh, and the third case since September in which plaintiffs were awarded damages. Just prior to this high award of $18.5M, a federal jury in Miami, Florida awarded $26.7M in a verdict against Boston Scientific for failing to provide sufficient warnings about the risks of its Pinnacle mesh implant device. Before these two cases, jurors awarded Martha Salazar $73 million in the case against Boston Scientific Corporation.

More than 67,000 cases have been consolidated in the federal court in West Virginia against seven mesh manufacturers. Boston Scientific, the Massachusetts-based company, is currently facing approximately 23,000 defective product lawsuits over their pelvic mesh products. According to Mesh Medical Device News Desk, some of the products "have been quietly removed from the market." Transvaginal Mesh and Transvaginal Slings are surgically implanted medical devices that were designed to treat Pelvic Organ Prolapse (POP) and/or Stress Urinary Incontinence (SUI), however, many women have come forward with complaints and reports of complications as a result of the implants.
Patty Kirby, COO and Head of Client Relations, commented on the recent verdicts against Boston Scientific, "The recent large awards in the two Boston Scientific trials are particularly troubling to the defendant, because $4M in one instance was for gross negligence. We believe that the longer Boston Scientific waits to settle these claims, the overall average settlement value or settlement range for the mesh plaintiffs could increase. Our sources close to this litigation believe that a global settlement is now imminent for Boston Scientific, though the company continues to fight their liability aggressively at this current time."
