Transvaginal Mesh Lawsuit Settlement News: Coloplast Increases TVM Budget by $448MM

According to Drug Watch, the Danish manufacturer (Coloplast) faces more than 2,000 pending lawsuits in the Southern District of West Virginia, in a multidistrict litigation court. Coloplast had settled 400 lawsuits against them in 2014 for $16 million plus about $93 million "worth of insurance for future legal costs. Almost all of the mesh manufacturers, with the exception of J&J's Ethicon, have announced or have been working toward settlements. J&J has over 33K active claims, yet they continue to contest liability. The J&J transvaginal mesh litigation is expected to drag on for years. The lawsuits against the different manufacturers allege that the transvaginal mesh devices and bladder slings caused serious injuries, and the manufacturers involved have had verdicts against them, and also have agreed to high settlements. Legal-Bay said when it is all said and done that the TVM mass tort litigation could go down as the largest of all-time. However, the company reports that the complexity of each case and various products makes it also the toughest one to resolve – as manufacturers are literally going from firm to firm to settle cases at the best negotiated price. This has caused a wide ranging of settlement figures for very similar cases.
