OAKLAND, Calif. and NEW YORK, Nov. 17, 2014 /PRNewswire/ -- A U.S. Federal Court judge last week entered final judgment in favor of TransPerfect relating to its technology that enables faster and more efficient translation of websites. Consistent with the jury verdict issued last summer after a three-week trial in U.S. District Court for Northern California, the court upheld the validity of TransPerfect's patent on the technology in question, and ruled that MotionPoint, a competitor, infringes that patent. The judge further confirmed the jury's finding that the three patents asserted by MotionPoint against TransPerfect are all invalid, and that even if those patents were valid, TransPerfect does not infringe them.
The court also entered a permanent injunction against MotionPoint and those acting in concert with them. Citing the length of time elapsed since the initial verdict, the judge gave MotionPoint 14 days—until November 26—to comply with its order to cease infringement of TransPerfect's patent. In addition to damages and royalties awarded in the initial verdict, MotionPoint was also ordered to pay TransPerfect a royalty of 4% of its revenues earned by using TransPerfect's technology post-verdict and until the injunction takes effect.
TransPerfect is the world's largest privately held provider of language translation services and related technology. Since 1992, TransPerfect has been owned and operated by its original founders, Phil Shawe and Liz Elting, who are Co-CEOs of the company.
Elting and Shawe jointly commented, "We've always believed steadfastly that TransPerfect is the rightful owner of the technologies that make up our OneLink website translation solution, and that it represents the best solution for clients that want to outsource their global websites using proxy-based technology. We are thankful to the jury and to the court for the vindication that this decision has provided."
TransPerfect was represented throughout the multi-year legal proceedings by lead attorney Douglas Lumish, Jeffrey Homrig, and Gabe Gross of Latham & Watkins, as well as co-counsel Okey Onyejekwe, Jr. of Kasowitz Benson Torres & Friedman, along with their respective teams in both Silicon Valley and New York.
