NEWPORT BEACH, Calif., March 11, 2020 /PRNewswire/ -- The Miller Law Firm has recovered $4,000,000 on behalf of the Vantis Maintenance Corporation in Aliso Viejo for their construction defect claims against well-known American home building company, Shea Homes.
Completed between September 2007 and July 2014, Vantis is comprised of 4 neighborhoods – Latitude South, Latitude North, City Walk and Elements – and 25 phases made up of a total of 307 residential units.
Putting Shea Homes on formal Notice of Building Performance Violations just shy of the 10-year statute of limitations, this $4,000,000 recovery was reached in mediation facilitated by Gerald A. Kurland of JAMS in less than two years. Now fully funded by Shea Homes' insurance parties, this settlement is dedicated to fix the numerous common area construction defects including, but not limited to: excessive soils settlement and building movement, structurally unsafe retaining walls and soil creep related damage to flatwork improvements immediately atop southern slope, waterproofing concerns at deck systems and balconies, roof issues, significant stucco cracking, corroded plumbing and sewer lines, and pool damage.
According to Thomas E. Miller, CEO of The Miller Law Firm, "The Vantis Board of Directors retained our services for their construction defect claim as the clock approached the 10-year time limit. The Board made the appropriate decision to retain construction defect counsel to obtain the funds required to repair the buildings and protect homeowner investments."
According to Senior Partner Rachel M. Miller, "It's important to understand that multi-phased communities can have several statutes of limitations. While the newly completed phases may be young, the earlier phases could be facing a strict 10-year deadline. We were able to determine when these statutes were triggered in order to preserve the Client's rights in holding the builder responsible for paying for these costly repairs."
