LOS ANGELES, March 9, 2015 /PRNewswire/ -- The Miller Law Firm has recovered $2,850,000, or nearly $34,000 per unit, for a Los Angeles Homeowners Association. The confidential settlement was reached in mediation, facilitated by Ross Hart, Esq. of AMCC (Arbitration Mediation Conciliation Center), in under 2 years from filing the complaint in Los Angeles Superior Court.
The 84-unit residential mid-rise condominium project is located on the West Side of Los Angeles. The Board of Directors retained The Miller Law Firm for a construction defect claim against the developer, architect and their insurance companies due damage from numerous construction defects.
The SB 800 claim and subsequent litigation concerned deficiencies in building construction and materials, including the absence of appropriate waterproofing, which led to water entering unit interiors. Other building deficiencies and violations of construction standards include missing or improperly placed area drains resulting in ponding and water intrusion at the walkways, garage, and podium deck, improper configuration of elevation levels and sloping resulting in standing water, and concentrated and excessive cracks on exterior stucco finish of the building at various locations.
