The Lanier Law Firm Readies for First Hearing in Nationwide Hip Implant Litigation
WEST PALM BEACH, Fla., Jan. 18, 2011 /PRNewswire/ -- The Lanier Law Firm and attorneys from around the country are gathering in Florida this week for the first status conference involving hip implant cases in In re: DePuy Orthopaedics Inc. ASR Hip Implant Products Liability Litigation (MDL 2197).
U.S. District Judge David A. Katz of the U.S. District Court for the Northern District of Ohio is holding the initial coordination hearing in West Palm Beach on Thursday, January 20.
The Lanier Law Firm filed the lead motion for national coordination of all DePuy hip implant lawsuits, and also filed the country's first hip implant claim in California after last year's recall.
"Consolidating this massive litigation allows thousands of faulty hip implant victims to have their cases handled more quickly and efficiently," says Mark Lanier, founder of The Lanier Law Firm. "This is the first step in resolving these lawsuits and making sure patients get the help they need."
Mr. Lanier and attorney Dana Taschner, who leads the firm's Los Angeles office, represent hundreds of DePuy hip implant patients across 30 states and overseas. The firm is providing information for patients online at http://www.recalledhip.com.
Johnson & Johnson recalled the two implants last year after many patients required a second surgery to correct problems. The recalled units, manufactured by Johnson & Johnson's DePuy Orthopaedics unit, include the ASR XL Acetabular System and DePuy ASR Hip Resurfacing System. More than 93,000 patients purchased the implants before the recall.
The firm's lawsuits allege that DePuy and Johnson & Johnson have known since 2007 that the hip implants were prone to fail based on a faulty design that causes metal-on-metal contact. Initial studies showed that more than 10 percent of DePuy implant recipients required corrective surgery within five years. New evidence presented this month by a British researcher indicates that the DePuy hip implants could have a failure rate as high as 50 percent within the first six years.
With offices in Los Angeles, Palo Alto, Houston and New York, The Lanier Law Firm represents clients across the U.S. in recalled hip implant claims, pharmaceutical liability lawsuits, product liability cases, and many others.
