The Lanier Law Firm Helps Injured Worker Win $5.5 Million Texas Verdict
Lubbock worker suffered severe head injuries after fall at West Star Transportation
LUBBOCK, Texas, Nov. 20, 2012 /PRNewswire/ -- Among all his courtroom victories, Texas attorney Mark Lanier of The Lanier Law Firm says a worksite injury case that was decided last week may be one of the most rewarding he's handled, and not just because his clients won a $5.5 million verdict.
"I've always wanted to try a case where I grew up in Lubbock, Texas, and I'm proud to have helped our clients win their lawsuit and move on with their lives," says Mr. Lanier, a graduate and major supporter of the Texas Tech University School of Law in Lubbock.
Mr. Lanier and attorney Jud Waltman of The Lanier Law Firm handled the case with Lubbock attorney Chris Carver on behalf of former Lubbock resident Charles Robison and his wife. The Robisons filed their lawsuit against Lubbock-based West Star Transportation Inc. after Mr. Robison suffered severe injuries while working at West Star in the spring of 2007.
"Charles has a long road ahead of him in terms of recovery, and this verdict will go a long way to making sure he is able to receive the medical attention he needs," says Mr. Lanier.
During the course of his work at West Star, a trucking company, Mr. Robison was attempting to place a tarpaulin over a piece of equipment that was sitting high atop the bed of a tractor trailer. Mr. Robison lost his balance, and fell approximately 15 feet before landing head-first on a concrete driveway. West Star provided no safety equipment or any other safer means of placing the tarp.
As a result of the fall, Mr. Robison suffered multiple skull and facial fractures and brain injuries that have affected his speech and mental functions. He is no longer able to work, care for himself, or live independently, and will require extensive medical treatment for the rest of his life.
Jurors in Judge Ruben Reyes' 72nd District Court in Lubbock returned their verdict on Nov. 14, 2012. The jury awarded slightly more than $1 million for physical pain, physical impairment and mental anguish; $411,724 for loss of earnings capacity; $3,716,575 for past and future medical expenses; and $400,000 for loss of consortium. The case is Robison v. West Star Transportation Inc., No. 2009-546,118.
