The Lanier Law Firm Announces California Patent Infringement Lawsuit for Atomic Precision Systems Against Intel, IBM, Others
PALO ALTO, Calif., Feb. 14, 2012 /PRNewswire/ -- The Lanier Law Firm is announcing a willful patent infringement lawsuit filed on behalf of Santa Clara, Calif.-based Atomic Precision Systems Inc. against a group of companies accused of infringing an Atomic Precision patent covering tools used for working with thin film technology in the creation of semiconductor devices.
The lawsuit, filed Feb. 13, 2012, in the U.S. District Court for the Northern District of California, San Jose Division, alleges that South Korea-based Jusung Engineering Co.; Round Rock, Texas-based Jusung America Inc.; Santa Clara-based Intel Corporation; Boise, Idaho-based Micron Technology Inc.; and Armonk, N.Y.-based International Business Machines Corp. (IBM) are infringing Atomic Precision's U.S. Patent No. 6,812,157.
The '157 patent covers an atomic layer deposition (ALD) reactor, which is used in high-end machines that put material onto semiconductor chips at the atomic level.
According to the lawsuit, Jusung infringed the patent by making and selling products that utilize the Atomic Precision technology in the Jusung Cyclone line of ALD tools. Atomic Precision also alleges that Intel, Micron and IBM are infringing the '157 patent by using Jusung's line of Cyclone ALD tools.
In August 2006, Jusung began licensing negotiations with Atomic Precision regarding the '157 patent. Those talks ended with Jusung not obtaining a license. Despite Jusung's failure to obtain a license, the complaint alleges, Jusung continued to manufacture tools that infringed the patent and unfairly benefitted from the use of Atomic Precision's technology.
