Mount Diablo Attorney Tried to Limit Union Rights
SAN BRUNO, Calif., March 21, 2013 /PRNewswire-USNewswire/ -- Teamsters Local 856 has filed unfair labor practice charges against the Mount Diablo School District over management's attempt to favor one employee organization over another in direct violation of the state's Education Employment Relations Act (EERA).

Earlier this week, several representatives from Teamsters Local 856 were passing out union handbills on public space in front of the Mount Diablo School District office. Shortly after they arrived, an attorney employed by the school district told the union representatives that they were not allowed on district property. She added that if they had been from the employee organization currently representing the workers, handing out literature would be fine.

"We knew that what the district's attorney was telling us was wrong," said Rudy Gonzalez, a representative with Local 856 who was one of the Teamsters the lawyer ordered to leave school district property. "Passing out fliers about the union in response to workers having expressed interest in joining the union is protected conduct under the EERA."
About 700 employees of the school district work as maintenance and operations, equipment operators, school bus drivers, mechanics, clerical employees and technicians.
