Taxotere Lawsuit Attorneys at Bernstein Liebhard LLP Discuss Most Recent Status Conference in Federal Hair Loss Litigation

NEW YORK, Feb. 8, 2017 /PRNewswire/ -- The federal multidistrict litigation established last year for Taxotere permanent hair loss claims continues to move forward in the U.S. District Court, Eastern District of Louisiana. According to court documents, the litigation convened its most recent status conference on January 27^th. Per a Joint Report of Liaison Counsel posted on the Court's website, at least 766 Taxotere lawsuits have either been filed in or transferred to the proceeding. Taxotere litigations are also underway in Missouri and California state courts, while a number of cases have been filed in Delaware. The parties are making efforts to coordinate with counsel to apprise them of the Court's willingness to cooperate with the state court judges for the purposes of coordinating discovery and other pretrial proceedings. The Report also noted that the Plaintiffs' and Defendants' Settlement Committees have had multiple telephone discussions and have held an initial in-person meeting to discuss regular meetings. The Settlement Committees are tasked with maintaining a continuing collaborative discussion regarding a framework for potential resolution of the Taxotere litigation.

Taxotere Hair Loss Allegations

Taxotere is a chemotherapy agent marketed by Sanofi-Aventis. It was initially approved to treat breast cancer in 1996, and is now indicated for head and neck cancer, gastric cancer, prostate cancer and non-small cell lung cancer.  While Sanofi has marketed Taxotere for two decades, it wasn't until December 2015 that any information regarding reports of permanent hair loss was included on its U.S. label. While alopecia is a common side effect of chemotherapy, plaintiffs claim that Taxotere is more likely to cause the permanent loss of hair compared to alternative, equally effective agents. While Sanofi did provide information regarding the potential for permanent hair loss to individual patients and regulatory agencies overseas, Taxotere plaintiffs claim that the U.S. label only included a generic, vague, and insufficient warning that "hair generally grows back"
