NEW YORK, May 17, 2017 /PRNewswire/ -- The Missouri state court overseeing hundreds of talcum powder ovarian cancer claims has consolidated three wrongful death cases for a trial scheduled to begin in June. According to papers filed in Missouri's 22nd Circuit Court for the City of St. Louis, all three lawsuits involve Decedents who allegedly incorporated Johnson & Johnson's Baby Powder and Shower-to-Shower products into their daily feminine hygiene routine for more than 25 years. All were allegedly found to have talc in their ovaries. (Case No. 1422-CC09326-01)
"Our Firm will be monitoring developments in these cases closely. We represent a number of plaintiffs in similar talcum powder lawsuits and the outcome of this trial could provide some clues as to how juries might rule in other ovarian cancer claims involving Johnson & Johnson products," says Sandy A. Liebhard, a partner at Bernstein Liebhard LLP, a nationwide law firm representing victims of defective medical devices, drugs and consumer products. The Firm is offering free legal reviews to women who were diagnosed with ovarian cancer that may be associated with Johnson & Johnson's talc-based powders.
Talcum Powder Litigation
Johnson & Johnson is named a defendant in more than 3,000 talcum powder lawsuits nationwide, all of which were filed on behalf of women who allegedly developed ovarian cancer following the regular and repeated use of the company's talc-based powders for feminine hygiene purposes. Plaintiffs involved in this litigation cite studies going back to the 1970s that suggest such a link, as well as internal Johnson & Johnson documents which purportedly show that the company was long aware of this danger but chose not to warn consumers out of a need to protect the profits derived from its talcum powder sales.
Missouri's 22nd Circuit Court, home to one of the nation's largest talcum powder litigations, has already convened five trials. Johnson & Johnson has prevailed in only one of these cases. The most recent trial concluded earlier this month, after Johnson & Johnson and Imery's Talc were ordered to pay $110 million in compensatory and punitive damages to an ovarian cancer victim who had used the company's talcum powders for more than 40 years. Plaintiffs in three other Missouri talcum powder trials have been awarded compensatory and punitive damages amounting to $70 million, $72 million and $55 million.
Women who were diagnosed with ovarian cancer following the long-term use of talc-based products for feminine hygiene purposes may be eligible to file their own talcum powder lawsuit.
