NEW YORK, July 31, 2017 /PRNewswire/ -- California's first trial involving talcum powder and ovarian cancer is now underway in Los Angeles Superior Court. During opening statements delivered on July 26th, the Plaintiff's attorney maintained that Johnson & Johnson concealed the risks associated with its Shower-to-Shower and Baby Powder talc-based powders to protect the company's image. The following day, a toxicology expert testifying for the Plaintiff told the assembled jury that "talc is toxic, and when used on a woman's genital area, can cause ovarian cancer." The witness also cited research suggesting that "regular small-dose application of talc" increased a woman's risk for the disease. (Johnson & Johnson Talcum Powder Cases, number JCCP4872)
"Our Firm is monitoring this trial closely, as we have been contacted by numerous individuals concerned that Johnson & Johnson talcum powder products caused ovarian cancer in themselves or a loved one. The outcome of this case could provide clues as to how juries might rule in similar talcum powder lawsuits," says Sandy A. Liebhard, a partner at Bernstein Liebhard LLP, a nationwide law firm representing victims of defective medical devices, drugs and consumer products. The Firm is offering free legal reviews to women who were diagnosed with ovarian cancer that may be associated with Johnson & Johnson's talc-based powders.
Talcum Powder Ovarian Cancer Litigation
Johnson & Johnson currently faces more than 3,000 talcum powder lawsuits in courts throughout the U.S. The case currently at trial in California was filed on behalf of a 63-year-old woman who had allegedly incorporated Johnson & Johnson talcum powders into her daily feminine hygiene routine for decades prior to her ovarian cancer diagnosis. Like other plaintiffs involved in the nationwide talcum powder litigation, she claims that Johnson & Johnson officials were aware of research published as early as the 1970s suggesting that the regular and repeated application of talc-based powders to the female genitals could contribute to the development of ovarian cancer.
One of the nation's largest talcum powder litigations is now underway in Missouri's 22nd Circuit Court in St. Louis, where seven trials have already concluded. So far, only one Missouri jury has delivered a verdict for Johnson & Johnson. Plaintiffs in four other talcum powder ovarian cancer lawsuits have been awarded compensatory and punitive damages amounting to $110 million, $70 million, $72 million and $55 million. (Case No. 1422-CC09326-01)
Women who were diagnosed with ovarian cancer following the long-term use of talc-based powder for feminine hygiene purposes may be eligible to file their own talcum powder lawsuit.
