Talcum Powder Lawsuit News: Federal Court Schedules First Conference for Ovarian Cancer Litigation, Bernstein Liebhard LLP Reports

NEW YORK, Oct. 21, 2016 /PRNewswire/ -- The multidistrict litigation established earlier this month for all federally-filed ovarian cancer lawsuits involving talcum powder products marketed by Johnson & Johnson will officially get underway in November. According to an Order issued in the U.S. District Court, District of New Jersey, on October 20^th, the Court will convene an Organizational Conference on Thursday, November 17^th at 10:00 a.m. to address "housekeeping" issues in individual cases. The Order further stipulates that the parties are to submit a Status Report by November 10^th that includes, among other things, suggestions as to lead and liaison counsel, as well as suggestions for agenda items to be discussed at the conference. Talcum Powder Litigation

The federal talcum powder litigation was established on October 4^th by an Order of the U.S. Judicial Panel for Multidistrict Litigation. Thirty-seven cases are already pending in the District of New Jersey, with additional cases awaiting transfer. Any future ovarian cancer claims filed in federal courts against Johnson & Johnson are likely to be transferred there as well.

Johnson & Johnson faces more than 1,800 talcum powder lawsuits in courts around the country. All of the cases put forth similar allegations regarding the potential for the company's Baby Powder and Shower-to-Shower products to contribute to the development of ovarian cancer when applied to the female genitals over a long period of time. Plaintiffs cite numerous studies dating back to the 1970s that suggest a link between talcum powder and ovarian cancer, and fault Johnson & Johnson for allegedly failing to provide any warnings to consumers.

Two additional centralized talcum powder litigations are already underway in St. Louis, Missouri and New Jersey Superior Court. In April, a St. Louis jury awarded $55 million in compensatory and punitive damages to an ovarian cancer victim who used Johnson & Johnson's talc-based powders for nearly 40 years as part of her feminine hygiene routine. In February, another Missouri trial ended with an award of $72 million for the family of a woman who died from the disease after using the company's talc products for more than 30 years.
