NEW YORK, Jan. 17, 2017 /PRNewswire/ -- Plaintiffs pursuing Stryker hip replacement lawsuits for injuries allegedly related to certain LFIT Anatomic CoCr V40 Femoral Heads are seeking to have all such federal claims centralized in a single U.S. District Court for the purposes of coordinated pretrial proceedings. According to a Petition filed with the U.S. Judicial Panel on Multidistrict Litigation on January 13th, at least six Stryker hip lawsuits involving LFIT V40 components are pending in federal courts around the U.S. However, plaintiffs contend that the litigation has the potential to include thousands of similar claims, pointing out that the devices were used in conjunction with at least six of Stryker's modular hip replacement devices. It is estimated that more than 100,000 LFIT V40 components may have been implanted in patients.
The petition further notes that three cases involving the LFIT V40 femoral head are already moving forward in the U.S. District Court, District of Massachusetts. Plaintiffs argue that transfer of the entire federal docket to the District of Massachusetts will "promote the just and efficient conduct of these actions." "Our Firm has heard from numerous Stryker hip replacement patients who suffered implant failures and other problems allegedly associated with a defective LFIT V40 femoral head. This litigation has the potential to be large, and may very well warrant the type of centralization sought by these plaintiffs," says Sandy A. Liebhard, a partner at Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is now offering free, no-obligation legal reviews to individuals who may have been harmed by Stryker's LFIT Anatomic CoCr V40 Femoral Heads.
Stryker LFIT V40 Femoral Head Recall
Stryker issued an "Urgent Medical Device Recall Notification" to surgeons in August2016, warning that certain LFIT femoral heads had been associated with "higher than expected number of complaints involving taper lock failure of the recalled femoral heads." Should the taper lock fail on these devices, patients may experience:
- Loss of mobility
- Pain
- Inflammation
- Adverse local tissue reaction
- Dislocation
- Joint instability
- Bone fractures around the components
- Leg length discrepancy
- Need for revision surgery
According to Stryker hip lawsuits, the company did not ask for the affected femoral heads to be returned and did not direct doctors to notify patients of the potential defect. The complaints further claim that Stryker knew for years that the LFIT V40 femoral heads were defective and dangerous, but chose to downplay the risk of using the components.
The creation of a multidistrict litigation for these Stryker hip lawsuits would allow all pending and future cases to undergo coordinated pre-trial proceedings, including discovery and motion practice. Multidistrict litigations are intended to improve judicial efficiency through the avoidance of duplicative discovery and inconsistent court rulings, and to preserve the resources of the court, parties and witnesses.
Compensation may be available to individuals who allegedly suffered pain, disability, and other complications resulting from the taper lock failure of a Stryker LFIT Anatomic CoCr V40 Femoral Head.
