Stryker Hip Lawsuit Settlement News: Judge Issues Order for Plaintiffs who have Required Revision Surgery, Says Lawsuitsettlementnews.com
Lawsuit help website reports that Judge Donavan Frank issued a Pretrial Order, mandating that plaintiffs who have undergone a corrective surgery due to a defective Stryker Rejuvenate or ABG II hip have 45 days to file notice with the court as part of their lawsuit.
ATLANTA, May 11, 2015 /PRNewswire/ -- MT Services LLC, a Lawsuit Settlement News Reporting Company which operates lawsuitsettlementnews.com, announced today that court documents issued on April 17th by U.S. District Judge Donavan Frank, Pretrial Order No. 26, mandate that plaintiffs who undergo a corrective surgery due to an alleged defective Stryker Rejuvenate or ABG II hip implant are required to file notice with the court within 45 days. Each plaintiff must provide the basic details of the surgery they have undergone as part of their lawsuit. A settlement was reached last year for plaintiffs who had a revision/corrective surgery on or before November 2nd of 2014, but additional claimants have continued to undergo corrective surgeries, resulting in the necessity for court updates. Judge Donavan Frank is overseeing the multidistrict litigation (MDL) relating to the Stryker Rejuvenate and ABG II replacement hips in the US District Court, District of Minnesota (Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, MDL No. 2441).
Currently, more than 5,000 lawsuits have been filed concerning both Stryker hip models since the 2012 recall. Due to the high number of claims, two litigations have been set up: the multidistrict litigation (MDL) in the U.S. District Court in the District of Minnesota, and a state-level multi-county litigation (MCL) which is taking place before Judge Brian R. Martinotti in Bergen County, New Jersey (NJ).
Chris Janish, CEO of MTS, commented on the recent court order, "The recent order shows the judge's intent to make sure that this hip recall litigation can move quickly to a final resolution. Since the settlement was announced at an average settlement amount or value of approximately $300K per hip, more claims have been filed and further revisions have occurred. However, the courts and Stryker are trying to require notification of revisions almost immediately. It is extremely important that anyone with an AGB II or Rejuvenate Hip case seeks counsel right now to preserve any rights they have to file a hip lawsuit."
MTS is ready to assist potential plaintiffs who need lawsuit help with finding a qualified Stryker hip law firm or hip recall lawyer to provide a free evaluation on their specific case. Stryker Hip recall settlement values have been announced at up to $300K per hip.
