Statement of Marc J. Bern on Behalf of the Law Firm Worby, Groner, Edelman & Napoli Bern About the James Zadroga Health and Compensation Act
NEW YORK, March 21 /PRNewswire/ -- As the attorneys representing the 10,000 workers who were injured as a result of their search, rescue and clean-up efforts at Ground Zero, we have strongly advocated for over six years that they receive just compensation. In addition to the settlement offer that we have been negotiating with the WTC Captive Insurance Co., Inc., representing the City and its contractors for the past two years, we have consistently supported the James Zadroga Health and Compensation Act which would extend "protections and services to individuals directly impacted by the terrorist attack in New York City." In fact, we worked closely with the Bill's sponsors on the legislation.
Because the passage of Zadroga has been delayed - it was first introduced four years ago - the settlement offer will provide the first guaranteed and immediate relief to our clients. The settlement offer should work in tandem with Zadroga if and when it is passed. We continue to strongly support the bill and urge Congress to make it clear in the final legislation that by signing on to the settlement, workers will not be precluded from taking advantage of Zadroga. Rather any settlement award should be an off-set to the compensation for which our clients are eligible under the legislation.
