State Of Texas Agrees -- GM Defect, Not Driver, Killed Fiance
CORPUS CHRISTI, Texas, Nov. 22, 2014 /PRNewswire/ -- Today, at Bob Hilliard's request, the State of Texas through the Van Zandt District Attorney's office agreed to stipulate to the admissibility of all of the evidence Hilliard sought to admit in the Candice Anderson hearing set for Monday, evidence confirming it was GM's defective ignition switch and not Ms. Anderson that caused the fatal accident which killed Gene Erickson, Ms. Anderson's fiance.
The hearing, styled a 'Writ of Habeas Corpus' based on actual innocence is scheduled to begin at 9:00 am Monday, November 24th, 2014 in the 294th judicial district, Van Zandt County, Texas, Judge Teresa Drum.
Hilliard is seeking to overturn Ms. Anderson's plea of guilty back in 2007. At the time, GM was actively covering-up the ignition switch defect in the 2004 Saturn Ion that killed Ms. Anderson's fiance, Gene Mikale Erickson. Ms. Anderson was charged with Intoxicated Vehicular Manslaughter and pled guilty to Criminal Negligent Homicide.
Hilliard states: "10 years ago GM got away with killing Gene Erickson. The district attorney's office has made a sound legal decision, as well as an admirable human decision. It now agrees Candice is not guilty of any crime. In fact, Leslie Pointer Dixon, who was the District Attorney at the time has authored a letter to the Board of Pardons laying sole blame on Gene Erickson's needless death at the feet of General Motors."
Hilliard also has requested GM join him and the District Attorney in seeking what he terms 'true and real justice.'
"For GM to have actual knowledge that this accident was only caused by its ignition switch defect yet silently watch as Candice, while mourning the death of her finance, was handcuffed, photographed for a mug shot and put into the criminal justice system, is in itself, criminal.
"GM could begin its years long journey on the road to atonement by finding the corporate courage to step up, as I have asked them to do, and announce to Judge Drum in open court on Monday morning that it joins my request to right this terrible wrong."
