Shegerian & Associates Founder Comments on President Obama's Proposed Executive Order in Support of LGBT Worker Rights

Shegerian, founder of Shegerian & Associates, a Santa Monica-based employment discrimination law firm, has issued a statement regarding an executive order to be signed by President Barack Obama in support of LGBT worker rights. President Barack Obama recently requested his staff draft the executive order, which would prohibit discrimination against LGBT workers within companies that do business with the federal government.
The President has been under pressure in recent months from LGBT advocates and activist groups to take executive action against sexual orientation discrimination in the workplace thereby fulfilling promises he made to do so earlier in his initial candidacy. The pressure is largely the result of the interrupted progress of the Employment Non-Discrimination Act (ENDA) which passed in the Senate earlier this spring but is currently stalled in the House.
The extent of the executive order is still in question as it has yet to be signed by the President, but many are hopeful that the reach of the order will fill gaps between the 18 states which cover sexual orientation discrimination and the rest of the nation which has little or no protection in place for LGBT workers.
"Moving forward with executive action to secure the rights of LGBT workers is a step in the right direction," said Shegerian. "While the Employment Non-Discrimination Act will assist with equalizing the playing field for these workers if passed, an executive order will, in the meantime, ensure protection against discrimination based on sexual orientation and motivate companies to comply with anti-discrimination law across the country."
Shegerian also added that the President's executive order will have the positive effect of balancing LGBT anti-discrimination legislation by possibly expanding coverage to more companies than ever before. Current federal anti-discrimination law covers companies with 15 or more employees, and many states such as California cover a larger number of companies, but there is currently no legislation which prohibits discrimination against LGBT workers regardless of company size.
