NEW YORK, Sept. 5, 2014 /PRNewswire/ -- The second federal trial of an Ethicon transvaginal mesh lawsuit (http://www.transvaginalmeshlawsuithelp.com/) concluded today, with victory going to the plaintiff, Bernstein Liebhard LLP reports. According to Reuters, the jury hearing the case in the U.S. District Court, Southern District of West Virginia has awarded $3.25 million to a woman who was implanted with the Gynecare TVT Obturator, or TVT-O, pelvic mesh device. Following two weeks of testimony, Johnson & Johnson's Ethicon, Inc. unit was found liable for selling a defective product, and for failing to warn patients and doctors about the risks associated with the device. (Huskey v. Ethicon, Case No. 12-5201)
According to court documents, the case was brought on behalf of a woman who had undergone multiple corrective surgeries after receiving the TVT-O implant to treat stress urinary incontinence. She continues to suffer from chronic pelvic pain despite the procedures to remove the mesh.
"Our Firm has been watching this trial closely, as we represent numerous women who are alleged to have experience similar complications following implantation of Ethicon transvaginal mesh products. We are very pleased with the jury's decision in this case," says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm continues to investigate transvaginal mesh lawsuits on behalf of women who suffered serious injuries, allegedly due to products marketed by Ethicon and other manufacturers.
Vaginal Mesh Litigation
According to court documents, Ethicon is named a defendant in more than 30,000 transvaginal mesh lawsuits pending in courts nationwide, including more than 21,000 that have been filed in the Southern District of West Virginia. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is serving on the Plaintiffs' Steering Committee for the federal Ethicon proceeding. (In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2327)
Court records indicate that Ethicon has lost two other transvaginal mesh cases that have gone to trial on the state level. In March 2013, a New Jersey Superior Court jury awarded more than $11 million in compensatory and punitive damages to a woman who was injured by the Gynecare Prolift device. Mr. Grand is currently serving as Co-Liaison Counsel in the Ethicon mesh litigation underway in New Jersey, and was a member of the Plaintiff's trial team. (Gross v. Gynecare Inc., Atl-L-6966-10)
In April 2014, juror hearing a case in Texas awarded $1.2 million to another victim of TVT-O mesh. (Batiste v. McNabb, No. 12-14350, District Court for the 95th Judicial District, Dallas County Texas)
In addition to his work on Ethicon mesh lawsuits, Mr. Grand is also a member of the Plaintiffs' Steering Committee for several other vaginal mesh litigations underway in the Southern District of West Virginia, including those involving: American Medical Systems, Inc. (MDL No. 2325); Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187). He is also serving as Co-Liaison Counsel in a second litigation underway in New Jersey Superior Court for transvaginal mesh lawsuits filed against C.R. Bard. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)
Women who allegedly suffered serious vaginal mesh complications following surgery to treat pelvic organ prolapse and stress urinary incontinence may be entitled to compensation from the company that manufactured the device.
