Hearing date set in Los Angeles County surrounding Charles Schwab defamation case BC574505, Michael Schwab defamation case BC573709 and Schwab Corporation Federal copyright case 2:14- CV-08433- AB-ARG
LOS ANGELES, Feb. 24, 2017 /PRNewswire/ -- The Court of Appeal, Second Appellate District has set a March 3, 2017 hearing date in Los Angeles Superior Court. The hearing is in connection with ongoing lawsuits filed by Charles Schwab and his son Michael Schwab against Nicholas Behunin for defamation.
Charles Schwab Corp. also filed suit against Nicholas Behunin on the same day as the Schwab family for copyright infringement (Federal copyright case 2:14- CV-08433- AB-ARG) before deciding to settle the lawsuit after Behunin filed a motion against the Schwab's to protect his right to freedom of speech. The "anti-SLAPP" is a motion that aims to protect the legal rights of individuals from strategic lawsuits against public participation. The lawsuits all stem from the contents of a website called www.chuck-you.com that Behunin published about the relationship between Charles Schwab and the Suharto Family of Indonesia.
"These lawsuits showcase some of the strong-arm tactics being used by the Schwab Family to suppress the truth. Chuck and his son are trying to use their power as billionaires to suppress my constitutional right to free speech and get me to keep my mouth shut," says Behunin.
Los Angeles resident Behunin claims Charles Schwab and his son, Michael Schwab, are involved in numerous business dealings with the Suharto Family of Indonesia.
"It is public knowledge that the Suharto Family has benefitted from strong-arm tactics and corruption for decades but Charles Schwab has made his billions selling trust and accountability. I would like people to know how Chuck really does business" say Behunin.
The anti-SLAPP motion filed by Behunin includes information on a real estate fund that Behunin says was created by the Schwab and Suharto Families.
"I have a constitutional right and they cannot silence me and suppress my right to freedom of speech," Behunin said.
Behunin accuses the Schwabs of fraud, negligent misrepresentation, breach of fiduciary duty and breach of contract. He is seeking compensatory damages of more than $25 million.
