Ross Feller Casey Files Lawsuit Against Maker and Co-Promoter of Testosterone Replacement Drug Testim on Behalf of Stroke Victim
PHILADELPHIA, March 13, 2014 /PRNewswire/ -- Ross Feller Casey, one of the nation's most accomplished personal injury law firms, has filed a lawsuit on behalf of an Alabama man alleging his use of the testosterone-containing drug Testim caused a stroke.
It is believed to be the first lawsuit brought in Philadelphia against a maker of a so-called "Low T" therapy drug, and one of only a few cases filed nationally to date.
"The pharmaceutical industry created a condition called Low T as part of a multibillion dollar marketing and sales campaign. There was sufficient medical evidence to reasonably know that these drugs would cause injuries," Ross Feller Casey founding partners Robert Ross, Joel Feller and Matt Casey said in a joint statement.
The suit was filed on behalf of Robert F. Hoehl and his wife, Kathleen, against the makers of Testim, Auxilium Pharmaceuticals, Inc., and the drug co-promoter, GlaxoSmithKline, LLC.
Hoehl, 64, of Anniston, Ala., suffered a stroke in July 2012, about nine months after he began taking Testim. The suit alleges that Testim caused the stroke, was unreasonably dangerous and had inadequate warnings, which created significant health risks to consumers at large, including Robert Hoehl. The lawsuit also accuses the makers of Testim — and other manufacturers of testosterone-containing drugs — of using deceptive marketing techniques to portray decreased testosterone levels as an "epidemic" and a "syndrome" when in fact they are a normal component of male aging.
In January, the FDA began reviewing the safety of testosterone replacement drugs following two recent studies that demonstrated significantly increased risk of heart attacks, strokes and other adverse events in older men.
Ross Feller Casey has been contacted by other men nationwide who also have suffered severe cardiovascular events while on or shortly after taking testosterone replacement drugs, such as Testim, AndroGel, AndroDerm, Axiron and Fortesta. The firm is currently investigating those cases and expects to bring additional lawsuits.
