Retiree also awarded attorney's fees after Mark Tepper Law Firm's win against Merrill Lynch for BreitBurn Recommendations
FT. LAUDERDALE, Fla., Aug. 15, 2017 /PRNewswire/ -- A Broward Circuit Court has ruled that in addition to damages, Merrill Lynch must also pay attorney's fees, interest and costs for a retiree. The ruling follows the successful arbitration results obtained by the Mark Tepper law firm against Merrill Lynch. The brokerage firm had recommended BreitBurn [OTCMKTS: BBEPQ], to the retiree.
"This means that our client doesn't have to pay fees now because the court has ruled that Merrill Lynch should pay. His recovery will not be reduced by attorney's fees, costs, lost interest, or the filing fee. That's the benefit to our client and a significant and welcome judgment by the Broward Circuit Court in granting our client's motions for attorney's fees and costs. We were determined that our client had faced enough hardship and should not have to pay a penny for our work in recovering the BreitBurn losses he suffered," Attorney Mark Tepper, the former Chief Trial Counsel at the New York Attorney General's Bureau of Investor Protection and Securities, said.
The Court's final judgement stated that its ruling was warranted in part because, "the arbitration results were substantially successful." It also ruled that the Mark Tepper law firm's client was entitled to Additional Arbitration interest, Prejudgment Statutory Interest and Taxable Court Costs.
A FINRA arbitrator had previously upheld the claim for damages against Merrill Lynch.
