Prominent Securities and Class Action Litigator Daniel Berger Joins Grant & Eisenhofer
Veteran trial lawyer has served as principal lead counsel in some of the largest investor recoveries on record and won two of handful of securities class actions ever to go to trial
NEW YORK, Sept. 13 /PRNewswire/ -- Leading shareholder and corporate governance law firm Grant & Eisenhofer announced that Daniel Berger, one of the country's preeminent securities litigators and class action attorneys, has joined the firm as a director.
Mr. Berger will be resident in the firm's New York office, working on both domestic and international litigation matters, particularly in shareholder and other investor cases for which the firm is renowned.
Mr. Berger brings more than 30 years of litigation experience, handling many of the largest and most complex securities cases during that time. Among numerous milestones in his career, he tried two 10b-5 securities class actions to favorable jury verdicts – among the very few such cases brought to trial.
Since 2006, Mr. Berger had been a member of noted litigation firm Pomerantz Haudek Block Grossman & Gross LLP. Previously, he spent 22 years with Bernstein Litowitz Berger & Grossman LLP, becoming a senior partner and serving as principal lead counsel in many of the largest securities litigations on record, in the process securing historic recoveries for investors.
Among just a few of his many successes, Mr. Berger obtained large recoveries in securities actions against Cendant Corp. ($3.3 billion), Lucent Technologies ($675 million), Bristol-Myers Squibb ($300 million), Daimler Chrysler ($300 million), Conseco ($120 million), Symbol Technologies ($139 million), and OM Group ($92 million). In his trial advocacy, Mr. Berger's work has routinely been cited by courts as having been instrumental in forming the basis of a final settlement or judgment.
"Dan Berger is one of the undisputed legends of the modern plaintiffs bar," said Grant & Eisenhofer co-managing director Jay Eisenhofer. "For decades, Dan was often the one who set the standard for many of us in terms of trial excellence, case strategy and also sheer force of will in getting the best possible results for clients. His track record is practically unsurpassed when it comes to big cases – we're truly honored to have him join us."
In addition to gaining major financial recoveries, Mr. Berger has had success before key federal appeals courts, arguing cases that made new law favorable to investors issued by the 3rd, 5th and 6th Circuits. He has also played a central role in important discrimination class actions, including obtaining $175 million for a group of African-American employees of Texaco, Inc. who accused the energy giant of racial bias.
G&E co-managing partner Stuart Grant noted, "Increasingly, many litigators have forgotten – or never even learned – the invaluable lessons of hard-fought trial work. No so for Dan Berger. He is a brilliant trial lawyer, who has achieved outstanding results before juries and judges. As our own practice expands beyond shareholder work into such areas as antitrust, False Claims Act and other segments of the law, Dan's trial expertise will be a terrific asset."
Mr. Berger said of his move to G&E: "From its launch in 1997, Grant & Eisenhofer quickly joined the short list of leading plaintiffs' firms, especially in securities class actions, as well derivative litigation and corporate governance disputes. I've had the pleasure of working alongside the firm and have watched its evolution into a leading advocate for institutional investors. Having known Stuart and Jay for a number of years, I am pleased at the opportunity to join the firm they've built and look forward to becoming an active member of their litigation team."
Mr. Berger earned a B.A. from Haverford College (1976) and his JD from Columbia Law School (1979). He spent four years as prosecutor with the New York State Attorney General's Office, serving as Assistant AG in the Civil Rights Bureau. He is a member of the Board of Visitors of Columbia Law and held a similar position at Haverford until 2003. He serves on the editorial board of Securities Law 360 and is a regular faculty member and panelist at PLI programs. He is a former board member of inMotion, Inc., which provides legal services to victims of domestic violence.
Note: Grant & Eisenhofer P.A. represents institutional investors, both domestic and foreign, in securities class actions, corporate governance actions and derivative litigation. The firm has recovered approximately $12 billion for shareholders in the last five years and was cited by RiskMetrics for securing the highest average investor recovery in securities class actions of any U.S. law firm in 2008. Grant & Eisenhofer has also been named one of the country's top plaintiffs' law firms by the National Law Journal for the past four years. The firm also represents plaintiffs in antitrust and False Claims Act litigation. For more information, visit www.gelaw.com.
