Obama, Modi Have Tryst With Democracy
Dinesh Sharma
Associate Research Professor
Binghamton University
On Jan. 26, the 65th anniversary of the adoption of India's constitution, President Obama was the first U.S. president to attend India's Republic Day. Says Sharma: "This is a rite of passage for both nations, made possible by the election of Prime Minister Modi, the vibrancy of the Indian people, and the long line of American diplomats who have kept the idea of India alive, including the recent push by the administration -- VP Biden, Sec. Kerry, Sec. Clinton and Sec. Hagel -- all traveling to India on recent diplomatic missions. Dr. B.R. Ambedkar, the architect of India's constitution, who studied at Columbia University with John Dewey, the American progressive philosopher who advanced the idea of educational equality, must be smiling now."
Sharma is associate research professor at Binghamton University's Institute for Global Cultural Studies in Binghamton, N.Y. He is the editor of the new book, "The Global Obama: Crossroads of Leadership in the 21st Century," published by Routledge Press. His previous book, "Barack Obama in Hawaii and Indonesia: The Making of a Global President," was rated as Top Ten Black History Book for 2012.

Gender Clouds Question of Parental Rights
Amber Liddell Alwais
Family Law Attorney
Orsinger, Nelson, Downing & Anderson, L.L.P. in San Antonio
Non-traditional families are taking note of the case of a transgendered Texas man's quest to continue his parental relationship with the two boys he helped raise for the better part of a decade while in a committed relationship with their mother. The visitation rights of a non-biological, non-adoptive parent are often murky enough under state law without the added factor of gender or sexual identity. Says Alwais: "There are very few legal remedies for the person who is not a biological parent when a relationship ends, even if they are the only mother or father the child has ever known. In this case, that challenge is magnified by the argument that he does not have standing because he was not born a male. The challenge to standing is the same that any parent in a same-sex relationship might face. But in general, if someone has otherwise proven to be a loving, nurturing parent, their gender should not be a legal impediment in determining whether allowing them to continue that relationship is in the child's best interest."

Feds Open Border to Mexican Truckers
H. Peyton Inge IV
Transportation Attorney
Chamblee, Ryan, Kershaw & Anderson, P.C. in Dallas
"The Obama administration's announcement that Mexican trucking companies will be allowed to operate in the United States should have little initial impact on U.S. carriers. Recently, the Federal Motor Carrier Safety Administration agreed to make permanent a NAFTA-driven pilot program that allowed qualifying Mexican long-haul truckers to make direct deliveries to U.S. destinations. Mexican carriers also will be permitted to carry goods back across the border. However, NAFTA does not permit foreign trucking companies to deliver goods between points within the U.S. Due to the safety requirements and restrictions governing how trailers are repositioned, it is unlikely we will see a significant increase in foreign trucks outside the border states. This could change if Mexican freight brokers organize to locate loads for trucks returning from the U.S."
