Preliminary Approval of Settlement Reached in Case Alleging Design Defect with Suzuki Motorcycle
PHILADELPHIA, March 1 /PRNewswire/ -- The United States District Court for the Southern District of Florida -- Miami Division granted preliminary approval of settlement in a breach of warranty class action suit brought against American Suzuki Motor Corporation and Suzuki Motor Corporation for damages allegedly caused from a design defect with the 2005 and 2006 Suzuki GSX-R1000 motorcycles.
Ruben Honik, Esquire, of the Philadelphia law firm, Golomb & Honik, P.C., negotiated the settlement on behalf of a class of more than 26,000 members after extensive investigations, discovery, motion practice, and mediation with Suzuki and its U.S. and Japanese counsel.
Plaintiff claimed that a threaded screw hole drilled into a non-weld location on the motorcycle's frame created innate structural instability creating the potential for the frame to crack or break while being operated. After this lawsuit was brought, Suzuki initiated a voluntary safety recall to enhance the frame strength and safety.
The GSX R-1000 is the most popular and best-selling model of the "sport bike" motorcycles manufactured by Suzuki, with annual sales estimated to be in excess of 13,000 units per year in the United States alone.
Although Suzuki denies any wrongdoing or liability, the parties agreed to settle the matter. "Owners of this model motorcycle now have additional meaningful remedies available to them as a result of this settlement agreement," explained Honik.
The final settlement hearing is scheduled to be heard on April 2, 2010.
