Postnuptial Agreements On The Rise Says Survey Of Nation's Top Divorce Lawyers
Wives Increasingly Requesting the Contracts
CHICAGO, Sept. 10, 2012 /PRNewswire/ -- More than half of divorce attorneys at 51% cited an increase in postnuptial agreements during the past three years in a recent poll of American Academy of Matrimonial Lawyer (AAML) members. In addition, 36% of the respondents have noted an increase in wives initiating the requests. Postnuptial agreements are voluntary contracts between couples who have already married and can cover a wide variety of issues, including possible conflicts over finances, property, assets, children, support, and probate matters.
"Postnuptial agreements are becoming a valuable tool to avoid trouble spots from escalating into serious conflicts that can jeopardize a marriage," said Ken Altshuler, president of the American Academy of Matrimonial Lawyers. "It is interesting to note the increase in wives requesting postnups, because often one of the most common motivators for these agreements is a dramatic change in the financial status of one or both partners during the marriage."
Overall, 51% of AAML members have cited an increase in the number of postnuptial agreements during the past three years, while 46% found no change. In addition, 36% of the respondents have noticed an increase in women requesting postnups during the same time period. Husbands are seen as the party most often to seek a postnuptial agreement at 42%, wives at 10%, and 48% noted no difference between the two.
