PLS Logistics Services Successfully Enforces Non-Compete Agreements in Pennsylvania Court
BEAVER, Pa., Nov. 9, 2010 /PRNewswire/ -- PLS Logistics Services, Inc., located in Cranberry Township, PA, approximately 20 miles north of Pittsburgh, PA, announces they have entered into a consent decree with former employee Andrew Spears and Sea2Sky Logistics. Under the terms of the decree, Sea2Sky is permanently disbanded and will no longer operate in any manner, and Andrew Spears, former principal of Sea2Sky, is prohibited from operating Sea2Sky or working with Hart Transportation in any capacity for the duration of the agreement.

On June 30, 2010, Andrew Spears resigned from his Director of Transportation position with PLS Logistics Services to pursue opening a competing business in the name of "Sea2Sky Logistics, Inc." Sea2Sky was advertised as a full service logistics provider, offering services that include logistics consulting, asset-based transportation, warehouse solutions and freight services.
On August 27, 2010, upon learning of the plans of Spears to open and operate Sea2Sky Logistics Company, Inc., PLS Logistics Services, Inc. filed a lawsuit (Case No. 12122-2010) in the District Court of Beaver County, Pennsylvania. The lawsuit sought to enforce the terms of the Employee Non-Competition, Non-Solicitation and Confidentiality Agreements signed by Spears with PLS Logistics Services, Inc.
The case was tried on September 9, 2010 in the Beaver County, Pennsylvania District Court by the Honorable District Court Judge C. Gus Kwidis. The final judgment entered by Judge Kwidis was the enforcement of the Non-Competition, Non-Solicitation and Confidentiality Agreements executed by defendant Spears were found to be valid and enforceable. The Final Judgment enjoins Spears and Sea2Sky Logistics from operating as a business entity for a period of one (1) year ending June 30, 2011. As a result of the outcome, Sea2Sky Logistics was ordered to take down their corporate website and cease any and all operations.
