PhaZZer Electronics Inc. is granted a second reexamination despite Taser International Inc. (Axon Enterprises Inc. AAXN) best efforts to validate their '262 patent
KISSIMMEE, Fla., June 5, 2017 /PRNewswire/ -- After the United States Patent and Trademark Office (USPTO) granted PhaZZer's request to reexamine the '262 patent-in-suit in the ongoing litigation between PhaZZer and Taser, Taser was forced to limit the scope of the broadest claims in the patent through amendment. The USPTO Examiner then indicated that the patent was allowable in view of the amendments and in view of a number of additional prior art references cited by Taser that were allegedly considered by the Examiner. As a result, a reexamination certificate for the '262 patent (the 11,087th) was issued on April 18, 2017.
In reviewing the Examiner's reasons for allowance, it became very clear to PhaZZer that much of the previously cited prior art was not properly considered. Furthermore, that prior art and additional relevant prior art subsequently discovered by PhaZZer clearly established that all the claims of the '262 patent were obvious. PhaZZer then filed a second reexamination request on April 27, 2017, which was quickly granted by a new USPTO Examiner on May 22, 2017. The new Examiner thoroughly analyzed the previously cited prior art and that supplied by PhaZZer in its second request and agreed that multiple substantial new questions of patentability were raised for all the claims in the '262 patent. PhaZZer believes that the second Examiner's analysis reflects the work that could and should have been done by the USPTO during the first reexamination. PhaZZer is confident that, in view of the prior art, all of the claims will be found obvious and the '262 patent will in due course be officially invalidated by the USPTO.
