Personhood USA: DCF files motion to dismiss case against family of Justina Pelletier
BOSTON, June 7, 2014 /PRNewswire-USNewswire/ -- Massachusetts DCF filed a court motion to reconsider and dismiss the case against Justina Pelletier's parents yesterday. Earlier in the week, DCF did not oppose the family's lawyers from filing a motion calling for Justina's immediate release.
The DCF motion for reconsideration and dismissal indicates that DCF has no further evidence to present or arguments to make at a hearing, and would allow Justina to return home without waiting for the June 20 court date. The juvenile court judge who has been handling the Pelletier case, Judge Joseph Johnston, could rule as early as Monday.
Reverend Patrick Mahoney, family spokesperson for the Pelletiers, said, "The way is now paved for Justina to go home, ending the nightmare she and her family have been a part of for 16 months, since she was unjustly taken from her parents.
Mahoney added, "We hope and pray that Judge Johnston will heed the recommendation of DCF's motion to reconsider and dismiss the case entirely. This has gone on far too long and she ought to be released immediately."
