NEW YORK, Sept. 11, 2017 /PRNewswire/ -- A Pennsylvania woman has been awarded $57.1 million, after the Philadelphia jury hearing her transvaginal mesh lawsuit found that Ethicon Inc.'s defective TVT implants had eroded into her urethra, resulting in permanent incontinence.
The case was the sixth Ethicon pelvic mesh lawsuit to go to trial in the Philadelphia Court of Common Pleas and the fifth to conclude with a decision for the plaintiff. The September 7th verdict followed nearly a month of testimony and two days of deliberations. Ethicon and its parent company, Johnson & Johnson, were ordered to pay the plaintiff $7.1 million in compensatory damages and $50 million in punitive damages. According to her lawsuit, Ella Ebaugh, 51, was implanted with two of Ethicon's TVT mesh devices which eroded in her urethra, forcing her to undergo several corrective surgeries. She continues to experience incontinence related to the implants. During the trial, Ebaugh's attorneys introduced evidence suggesting that Johnson & Johnson intentionally manipulated medical literature to downplay complications associated with TVT mesh and failed to warn doctors and patients about these risks.
Juries in Philadelphia have awarded four other Ethicon transvaginal mesh plaintiffs damages of $12.5 million, $13.6 million, 17.5 million, and $20 million in damages. Johnson & Johnson have so far prevailed in only one case. In July, however, the Court granted the plaintiff's post-trial motion requesting a new hearing on damages.
Johnson & Johnson and Ethicon are facing more than 55,000 transvaginal mesh lawsuits in courts nationwide. Plaintiffs claim that the devices, which are indicated to treat women suffering from pelvic organ prolapse and stress urinary incontinence, caused a wide range of painful complications, including the erosion of mesh into the vaginal wall, adhesions and scarring, chronic infections, permanent pain, and incontinence.
