NEW YORK, May 10, 2017 /PRNewswire/ -- A jury is now hearing evidence in Pennsylvania's fourth trial involving allegedly defective transvaginal mesh implants manufactured by Johnson & Johnson's Ethicon, Inc. division. This latest case was filed on behalf of a 45-year-old woman who says she has experienced chronic pain and discomfort since being implanted with Ethicon's Gynecare Prolift mesh to treat stress urinary incontinence and pelvic organ prolapse in 2006. During Monday's opening arguments in the Philadelphia Court of Common Pleas, the Plaintiff's attorney argued that his client had not been fully apprised of the risks associated with Prolift mesh, which he asserted had only been tested on 175 women prior to its introduction in 2005. Johnson & Johnson Transvaginal Mesh Litigation
Some 54,000 personal injury lawsuits involving Ethicon's transvaginal mesh devices are now pending in courts nationwide. While Johnson & Johnson and Ethicon have prevailed in some of these cases, Bloomberg News reports that five juries have awarded plaintiffs a total of $55 million since 2014. Just last month, the jury hearing evidence in Pennsylvania's third transvaginal mesh trial ordered the companies to pay $20 million in punitive and compensatory damages to a woman who has been in constant pain since being treated for incontinence with Ethicon's Gynecare TVT-Secur implant. Pennsylvania's juries have awarded $12.5 million and $13.5 million to two other transvaginal mesh plaintiffs.
The litigation surrounding transvaginal mesh began to gain momentum in 2008, after the U.S. Food & Drug Administration (FDA) revealed that such devices had been implicated in at least 1,000 reports of serious injuries over a three year period. In July 2011, the agency warned that the number of complications reported in relation to the use of transvaginal mesh in prolapse repair had tripled since its prior alert. Most significantly, the FDA modified its previous stance that such injuries were rare.
In 2012, Ethicon announced it would stop selling four transvaginal mesh devices, including Gynecare TVT Secur system, the Gynecare Prosima, the Gynecare Prolift and the Gynecare Prolift+M. The company maintained that the decision was the result of "changing market dynamics" rather than safety concerns. Six months earlier, however, the FDA had ordered Ethicon and 20 other vaginal mesh manufacturers to conduct further research into the risks associated with their implants.
