WASHINGTON, March 14, 2013 /PRNewswire/ -- Patton Boggs LLP successfully challenged the award of a $100+ million contract by the District of Columbia Department of Transportation (DDOT) to manage and upgrade Washington DC's network of 70,000+ streetlights.

Representing Citelum DC LLP, Patton Boggs filed the protest with the District of Columbia Contract Appeals Board (CAB) in July 2012, in protest of DDOT's award of the contract to MC Dean. The DC CAB rendered its decision setting aside the award to MC Dean on March 1.
This high-profile procurement constituted the largest street-light management contract in DC history, and one of the largest ever in the United States. It was identified in DC Mayor Vincent Gray's 2012 State of the District Speech, and was the subject of various media reports throughout 2012 and 2013.
The protest cited a variety of procurement improprieties, including the failure of the city to officially appoint a contracting officer (CO) to oversee the procurement, inequitable treatment of bidders, and DDOT's failure to conduct a cost realism analysis prior to award.
In setting aside the award, the DC CAB also directed DDOT to re-issue the streetlight solicitation and to ensure that all bidders submit proposals in response to identical requirements. As a result of the decision, Citelum DC will be in position to seek award of the contract on an equal footing with all those seeking award, including MC Dean.
