Patent Infringment Determined And Judge Orders Permanent Injunction, Protecting The Maker Of The Ekobrew® Filter, And Banning Sales Of Infringing Eco-Fill And Eco-Flow Products
WOODINVILLE, Wash., July 18, 2018 /PRNewswire/ -- In a powerfully worded Post-Trial Order, a patent-infringing competitor of Eko Brands was instructed to cease all distribution, sale and promotion of its infringing products. This permanent injunction against Adrian Rivera Maynez Enterprises Inc. ("ARM") protects Eko Brands, the creators of the Ekobrew® reusable coffee filter. In the trial ARM admitted infringement of Eko Brand's patent and the judge ordered a permanent injunction barring ARM from selling its infringing products, including but not limited to the Eco-Fill Deluxe, Eco-Fill Deluxe 2.0, Eco-Flow v1 and Eco-Flow v2.

In addition to permanently barring the sale of ARM's infringing products, the Court concluded that ARM's defense was done in part in bad faith and awarded Eko attorney's fees. In the Post Trial Orders, the judge labelled ARM's litigation tactics as "scorched earth" and indicated that he was "not impressed with ARM's courtroom stunts," some which he described as a "charade." He further described ARM's witnesses as "not credible."
