Paskenta Band of Nomlaki Indians Reaches Agreement to Settle Leadership Dispute

CORNING, Calif., July 7, 2014 /PRNewswire/ -- The Paskenta Band of Nomlaki Indians announced today an agreement that ends the ongoing dispute over control of the Tribal Council and Tribe's assets.

With the Tribe's election just over two months away on September 13, both sides agreed that the best way to handle the dispute is to allow the members of the Tribe to determine the Tribe's governing body at the election.

In an effort to encourage as many Tribal members to participate in the election as possible and to address any issues surrounding membership, voting rights and full Tribal benefits will be available for any person who was enrolled as a Tribal member after January 1, 1999.   

Both sides agreed that it is in the Tribe's best interest to end the dispute and handle this internal Tribal matter through the appropriate Tribal government channels.  In ending the dispute, the agreement calls for the status quo to be maintained at the Tribe's Rolling Hills Casino Resort in Corning.

Other pertinent components of the agreement include:  

• The Tribe will continue to adhere to the temporary restraining order recently issued by a federal judge and the parties will stay all federal, tribal and administrative litigation.
• A mutually agreed upon CPA firm or forensic auditor will investigate all alleged financial improprieties and both parties will cooperate in good faith.
• A mutually agreed upon third party will supervise the September 13 election.
• No disenrollments will occur prior to the September 13 election and the parties will agree upon a third party to address constitutional membership requirements.   

The agreement is effective immediately and will remain in effect until the September election, when both parties agree to recognize the election results.
