Parker Waichman States Notice of Claim Filed with Garden City Union Free School District in Bullying Case
PORT WASHINGTON, N.Y., Oct. 24, 2017 /PRNewswire/ -- Nicholas Warywoda, Senior Trial Attorney of the personal injury law firm of Parker Waichman LLP, is taking on the Garden City Union Free School District this time. Warywoda, the lawyer who in April 2017 won an $8 million verdict against the medical provider at the Nassau County (New York) jail for failing to properly treat a Marine Corps combat veteran, causing him to commit suicide, has filed a Notice of Claim against the Garden City Middle School, a National Blue Ribbon School of Excellence, alleging, among other things, that the district failed to provide 13 year old Liam O'Brien, an eighth grade student at the school, with a safe and supportive environment free from intimidation, taunting, physical abuse, harassment, and bullying on school property and/or at school functions.
Keith & Deirdre O'Brien claim that their son, Liam, was bullied at the Garden City Middle School on a daily basis throughout the seventh grade. The bullying continued during the first week of school this September when Liam was shoved face first into a locker in the school's locker room causing him to sustain a serious contusion of the face. Liam's mother, after being told by the personnel at the Garden City Middle School that their investigation into her son's allegations of bullying were "unfounded" took to social media to share their experience and raise awareness. As reported by NBC New York News, Deirdre Fell-O'Brien's Facebook post went viral throughout Garden City, Long Island and the state.
Liam has spent the last 6 weeks hospitalized and remains an inpatient at a Princeton, New Jersey medical center being treated for an eating disorder and depression.
A Notice of Claim has been served on the Garden City Union Free School District putting the district on notice of the claimants' intention to file a lawsuit.
