Parents of Good Samaritan shot and killed at Houston Chevron station file wrongful death lawsuit against station owner and operator, reports The Law Offices of John David Hart
FORT WORTH, Texas, Sept. 12, 2012 /PRNewswire/ -- A Texas mother and father have filed a wrongful death lawsuit against the owner and operator of a Houston area gas station where their son was shot and killed in 2010.
Twenty-four-year-old Samuel Irick was shot and killed on November 11, 2010 while aiding a fellow customer who was being robbed outside a Chevron station in the Bellaire area of southwest Houston. The gas station, located at 4680 Beechnut Street, is owned and operated by DZ Beechnut, L.P. Houston police later arrested Anthony Ray Ferrell and charged him with capital murder for the death of Samuel Irick.
"Samuel lost his life helping a young woman being robbed. He was a Good Samaritan in the truest sense of the words," said attorney John David Hart of the Law Offices of John David Hart in Fort Worth, who represents Samuel's parents, Randi Wood and Stan Irick. "Tragically, his death would have been avoided if the station had meaningful security procedures in place or shown basic common sense and alerted the police to the killer who had been loitering and drinking beer on the premises. A Houston Police Department substation was less than a mile away, a simple phone call would have brought the authorities and likely prevented the needless loss of life."
The lawsuit, filed in Harris County, alleges that DZ Beechnut, L.P. and Daniel L. Zalta failed to provide adequate security and failed to protect or warn Samuel Irick of the dangerous condition on the property.
