Pardee Resources Company: Summary Judgment Motion in Kings Dome Case Reversed
PHILADELPHIA, June 4 /PRNewswire/ -- On May 28, 2010, the Louisiana Second Circuit Court of Appeal ("Court of Appeal") rendered a decision in the litigation involving Pardee's mineral servitude in the Kings Dome Field. The Court of Appeal reversed the summary judgment granted in favor of Pardee and its lessee. After discussing the issues raised by the parties and examining the evidence in the record, the Court of Appeal concluded that there are disputed issues of fact precluding summary judgment and that a trial on the merits is required to determine whether Pardee's mineral servitude had been preserved by prior operations.
Pardee is considering whether to proceed to trial or take writs to the Louisiana Supreme Court to challenge the Court of Appeal's decision.
