PA Human Relations Commission Orders Pittsburgh Business to Pay More Than $135,000 in Discrimination, Retaliation Case
HARRISBURG, Pa., May 26 /PRNewswire-USNewswire/ -- The Pennsylvania Human Relations Commission ordered QponDirect Inc., of Pittsburgh, to pay Lisa Ann Vozel, of Irwin, Westmoreland County, more than $135,000 in back pay, interest and expenses for illegally retaliating against Vozel and discriminating against her based on her age, sex and disability. The order took effect May 25.
Vozel filed a complaint alleging that her former employer failed to accommodate her disability, promoted a younger male over her, and eventually dismissed her in retaliation for filing a complaint of illegal discrimination.
"Investigating illegal discrimination complaints requires input from both the accuser and the accused," said Stephen A. Glassman, chairperson of the commission. "When someone is served with a complaint, Pennsylvania law requires them to respond. If they do not, we are forced to find them liable for illegal discrimination."
Despite multiple notifications, QponDirect never answered the complaint. The commission found the business liable for illegal discrimination and held a public hearing to determine appropriate damages.
The commission's order awards Vozel back pay of $127,065, plus interest, for wages lost after her dismissal, and $89 for out-of-pocket expenses. Six percent interest per annum is calculated from the date of her dismissal, March 5, 2008, until full payment is made. To date, the interest brings Vozel's award to more than $135,000.
The commission also ordered the business to cease and desist discriminating against employees.
The company has 30 days to report to the commission on how it will comply with the order.
