NUBY® Wins Injunction Stopping Worldwide Sales of Tommee Tippee Copies
MONROE, La., May 28, 2013 /PRNewswire/ -- A court-ordered worldwide injunction is now in full force as of Friday the 24th of May, prohibiting Jackel International (the UK maker of Tommee Tippee brand baby products, owned by private equity group 3i) and all affiliates from selling, offering for sale, advertising, marketing and/or promoting any copies of NUBY®'s silicone compression valve: (1) soft spout cups, (2) flip-top cups, and (3) straw cups.
A jury found Jackel in violation of Louisiana's unfair trade practices act and in breach of contracts in connection with their copying and imitating Luv n' care's proprietary NUBY® brand no-spill drinking products. As a result of Jackel's violations, Luv n' care was awarded both attorneys' fees, costs and significant monetary damages in excess of $1.4 million, and the Honorable 4th Judicial District Court Judge ordered a permanent injunction stopping worldwide sales of the aforementioned Tommee Tippee products.
This lawsuit follows a string of successful legal victories and ongoing proceedings to protect NUBY's rights in its innovations, including suits against: Jackel, Walgreens, Atico, Royal King of Thailand, Kmart, Sassy, The First Years, Philips GmbH (parent company of Philips AVENT), Baby King, Novatex, and others.
