NEW YORK, April 10, 2015 /PRNewswire/ -- Zofran birth defect lawsuits continue to mount in courts around the country, after two families came forward with new cases last week. According to court records, a complaint filed on April 1st in the U.S. District Court, Northern District of Alabama, alleges that prenatal exposure to Zofran was responsible fora number of serious birth defects. (Case 2:15-cv-00544-JEO) A second complaint filed in the U.S. District Court, District of Montana on April 3, 2015 claims that a baby born in 1998 sustained a cleft palate due to her mother's use of Zofran in the first trimester. Among other things, the lawsuit seeks compensation for the 10 surgeries she has undergone to correct the problem. (1:15-cv-00026-SPW-CSO)
"Like other recent Zofran lawsuit filings, court records indicate that these complaints accuse GlaxoSmithKline of concealing the association between Zofran and birth defects, and of improperly marketing the medication to relieve pregnancy-related nausea and vomiting," says Sandy A. Other Zofran Lawsuits
Court records indicate that at least three other Zofran lawsuits are pending in U.S. courts, all of which claim that use of the drug in early pregnancy increases the risk that a baby will be born with a serious birth defect. These cases include a claim filed on March 6th in California's Alameda Superior Court that alleges prenatal Zofran exposure caused a little boy to suffer a heart rhythm problem called supraventricular tachycardia. (Case No. RG15761042) A case filed on February 16th in U.S. District Court, District of Massachusetts claims that Zofran caused a baby girl to be born with a number of congenital abnormalities, including heart defects. (Case 1:15-cv-10429) Two other children are alleged to have suffered Zofran-related heart defects in a case that was filed on February 12th in the U.S. District Court, Eastern District of Pennsylvania. (Case 2:15-cv-00709-PDC)
All of these lawsuits point out that Zofran, known generically as ondansetron, is only approved to prevent nausea and vomiting experienced by post-operative surgery patients, as well as cancer patients undergoing certain types of chemotherapy and radiation. The complaints further note that the U.S. Food & Drug Administration (FDA) classifies the drug in Pregnancy Category B, which indicates that it has not been well studied in pregnant women.
