New York Workers' Compensation Lawyer Adnan Munawar Comments on Workers' Compensation Eligibility Declared for Man For Company Kickball Injury
New York Workers' Compensation Lawyer Adnan Munawar, of Munawar & Andrews-Santillo, LLP issues a statement after the South Carolina Supreme Court determined a man was eligible for workers' compensation for injuries stemming from a company kickball game.
NEW YORK, Sept. 5, 2014 /PRNewswire/ -- In what may come as a surprise to some, if a person is injured in a company kickball game, he or she can be eligible for workers' compensation benefits, according to the U.S. News and World Report (South Carolina Supreme Court: Workers' Compensation OK for Injuries from Company Kickball Game, August 27, 2014). At least that's the case now in South Carolina.

The man seeking workers' compensation benefits was Stephen Whigham, an employee of Jackson Dawson Communications, a public relations firm. Mr. Whigham organized a kickball game as a team-building event for employees and shattered two bones in his leg while trying to avoid a tag. Mr. Whigham eventually needed a knee replacement, but his initial workers' compensation claim was denied. Eventually, the high court ruled in his favor, finding that because Mr. Whigham had to be at the game since he was the organizer, it was part of his job.
"While this case may be fairly unique, it still stands to show the potential strength of the workers' compensation system," said Adnan Munawar, Partner at Munawar & Andrews-Santillo LLP. "The whole idea is that people should be able to do their jobs and the activities required by them without fear of suffering the consequences of an injury alone. This man suffered a severe injury while on the job, and while it was during a seemingly recreational activity, it was still part of his job and his injury should be covered."
"People should keep in mind, however, that different states rule differently over the same issues and one should not use South Carolina's logic to make a decision somewhere else. This is one of many areas in which you will want to consult with an expert who has knowledge of your state's laws and interpretations and who can best advise you if you are injured on the job. If an injury is preventing you from working and you need benefits to replace your income while you recover, you will want to know that your claim is being handled as effectively and efficiently as possible. And remember, you only ever pay an attorney fee if your claim is successful, so there is no reason not to seek professional assistance with your claim."
"If your or a loved one has suffered an injury or worse caused by the performance of a job, contact a New York Workers' Compensation lawyer to receive information about the workers' compensation claim process and get your claims started right away."
